LNAPL Regulatory Change, Guidance and Progress

Registration: Registration must take place during business hours (8 am to 6 pm Mon. - Fri.). Within 24 hours of registration, the LSPA will provide your registration information via email.  
Availability: Once you have your login information, the course may be accessed at any time for 30 days through a web browser. At the end of 30 days, your access is terminated. No extensions will be offered. 
Technology: The course may be accessed using a computer, tablet or mobile device. All you need is a web browser and access to the Internet. Preferred browsers include: Google Chrome, Safari, Edge and Firefox. Please note: Internet Explorer 11 (IE11) is not a supported browser.

This course, approved for 4.0 DEP Regulatory continuing education credits (#1676A), was offered in-person in February 2020, October 2019 and November 2019. Depending on your LSP renewal date, if you received credit then, you may be unable to receive credit for taking this course. Refer to 309 CMR 3.09(2)(c).

Course Description: 
This four-hour MassDEP Regulatory course is designed to provide LSPs and other interested parties with an in-depth review of: 

  1. How the 2014 amendments to the Massachusetts Contingency Plan (MCP; 310 CMR 40.0000) relating to Light Nonaqueous Phase Liquid (LNAPL) are being used by practitioners; and
  2. Some of the related challenges involved with moving sites to closure. 
The course will be moderated by Ken Marra of MassDEP. Mr. Marra will introduce course topics and will lead the panel discussion at the end of the course.
 
Steve Boynton, the lead author of the 2005 and 2008 LSPA LNAPL White Papers and LSPA lead for the LNAPL work group, will provide an overview of the LSPA White Papers relating to improved LNAPL assessment techniques and recommended regulatory changes.  
 
Ken Marra will then provide a detailed review of the 2014 MCP Amendments, followed by a presentation of recommendations and implementation challenges related to the 2016 MassDEP Policy "Light Nonaqueous Phase Liquids (LNAPL) and the MCP: Guidance for Site Assessment and Closure" (policy #WSC-16-450).
 
Wesley Stimpson, former LSP and LSPA Past President, has been reviewing the content of Permanent Solutions, and Activity and Use Limitations (AULs) for LNAPL sites since promulgation of the 2014 LNAPL regulations. Mr. Stimpson will provide a review of his findings and recommendations for appropriate submittals.
 
Steve Gaito, a member of the ITRC Site Characterization and ASTM NAPL in Sediments teams, will present the "Simplified Method" and the alternative "Multiple Lines of Evidence" approach.  Mr. Gaito will also discuss Natural Source Zone Depletion and Alternative LNAPL Transmissivity test procedures.
 
A round table discussion moderated by Ken Marra of MassDEP will follow formal instructor presentations. The instructors will present short case studies to highlight important elements of the 2014 regulations and guidance document.

Registration Process:
Once you complete your registration form for the course, you will receive three emails from the LSPA:

  1. Your registration confirmation.
  2. A copy of your invoice which acts as a paid receipt.
  3. An email containing your log-in information and link to directly access the online course. Once this email is sent, you will have 30 days to complete the course. Access to the course and the quiz will automatically expire in 30 days. There will be no extensions or exceptions. 

Please note: To receive your CEU, you must successfully complete the quiz and log out of the Learning Management System.
