Course Description: 
In the five years since the addition of PFAS to the MCP, significant changes have been made to the regulatory status of selected PFAS compounds at the national level, and PFOS and PFOA have been added to the list of CERCLA-defined hazardous substances assessed in the ASTM E 1527-21 process. This course will provide a summary of the current state of PFAS due diligence and recent regulatory developments, with a focus on case studies of known and suspected PFAS release sites, and understanding how to help stakeholders identify and manage PFAS-related risks. 

In addition to case studies of properties where PFAS-related findings were identified, the course will include:

  • The timeline of regulatory changes affecting PFAS findings in due diligence;
  • Evaluating PFAS-related risks based on potential sources, suspected pathways, and area groundwater use;
  • Specific research methods used to evaluate the potential for PFAS-related findings, including their advantages and drawbacks;
  • Potential next steps following the identification of PFAS-related findings; and
  • Understanding stakeholders’ risk considerations, including risks to on- and off-site human receptors, transactional risks, regulatory risks, and litigation risks.
